Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website trakr.studio and the Trakr application at app.trakr.studio (collectively, the “Service”) provided by Creative Data Engineers LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are

Creative Data Engineers LLC is a U.S.-registered single-member LLC providing digital analytics tools and consulting services to clients globally, including within the European Union.

2. Description of Service

Trakr is a guided campaign URL builder for marketing and analytics teams working with Google Analytics 4 (GA4). The Service allows users to generate UTM-tagged URLs that comply with their organization’s naming conventions and GA4 channel grouping rules.

The Service is live at app.trakr.studio. You can build URLs on a free plan without a subscription. Paid Pro plans add team and workspace features, as described at the point of purchase.

3. Eligibility

By using the Service, you confirm that you are:

• At least 18 years old
• Authorized to enter into legally binding agreements
• Using the Service for business purposes

4. Waitlist and Product Updates

If you submit the waitlist or product-updates form, you provide your first name and email address, and you agree to receive product-related emails. You can unsubscribe at any time via the link in each email or at trakr.studio/unsubscribe.

Signing up for updates does not guarantee a specific price or feature set. The free plan is available now without signing up for updates.

5. User Responsibilities

When you use the Service, you agree to:

• Provide accurate information
• Keep your account credentials secure
• Comply with all applicable laws, including data protection regulations
• Not attempt to reverse-engineer, scrape, or interfere with the Service

6. Fees and Payment

Trakr offers a free plan and paid Pro plans. The free plan has no fees.

Fees for paid plans are shown before purchase and processed via Stripe. Unless stated otherwise, all amounts are exclusive of applicable taxes. Subscriptions renew automatically until cancelled; you can cancel at any time from your account settings.

7. Intellectual Property

• URLs you generate: the URLs you create using Trakr are yours.
• Configuration data: workspace configurations, naming conventions, and field definitions you create belong to you.
• The Service itself: Trakr’s code, design, methodology, and documentation remain the sole property of Creative Data Engineers LLC.
• You may not copy, modify, distribute, or create derivative works of the Service without written permission.

8. Data Protection

We process personal data in compliance with GDPR where applicable. See our Privacy Policy at trakr.studio/legal/privacy-policy.html for details on what data we collect and how we use it.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruptions.
• Our total liability for any claim arising from these Terms or the Service is limited to the total amount you paid us in the 12 months preceding the claim (or zero if no payment has been made).
• We do not guarantee that the Service will be error-free, uninterrupted, or that generated URLs will produce specific results in Google Analytics or any other platform.

10. Disclaimers

The Service is provided “as is” and “as available.” We make no warranties that:

• The Service will meet your specific business objectives
• GA4 channel grouping rules will remain unchanged by Google
• Third-party integrations will remain operational indefinitely
• Generated URLs will produce specific attribution results

Trakr validates URLs against documented GA4 default channel grouping rules. Google may change these rules at any time. We will update the Service when changes are published, but we cannot guarantee real-time parity.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if continuing service would violate applicable law. You may stop using the Service at any time.

Upon termination, outstanding payment obligations remain due. Data deletion follows the schedule in our Privacy Policy, or you may request earlier deletion.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA. Where required by GDPR or applicable EU consumer protection laws, local mandatory regulations also apply.

For disputes, we aim to resolve issues directly. If unresolved, disputes shall be submitted to the competent courts of the LLC’s registered jurisdiction, unless otherwise required by mandatory local law.

13. Changes to These Terms

We may update these Terms to reflect changes in the Service, legal requirements, or business practices. Updates will be posted at trakr.studio/legal/terms-of-service.html with an updated effective date. Continued use of the Service after changes constitutes acceptance.
